I am about to have an online auction website developed. Should I wait and have an LLC in place before taking the development step. The website is only going to take 3 weeks to be developed and I can have the site up and running within a week after that.
I want to do this legit so I am not breaking any laws. Please any advice would be appreciated

I would get an llc to protect your personal assets.
Remember the online auction business is very tough and very competitive.
You may want to try something new rather than the same old boring ebay style auctions.
Have you heard of swoopo? They have an exciting business plan that may work for you.

They make money when you buy bid packs and they hope that the income from the bid packs is more than the difference of the price someone pays for the item and the amount the item cost them.
They seem to making a fortune and you can find a coder to build your site for $100 or less.
If you go with a traditional ebay style auction site you can have someone set that up for you with a ready made script for $50.

i have been using ebay but it would be great if an online auction did not have listing fees.

for that reason.
some states now try to demand collection of sales taxes and they are
heavily handing some sites like ebay and amazon to collect taxes. IT is not legal but
they do it anyway.

I want to set up an art auction online for a charity. People are willing to donate their art, but I’m not entirely sure how to go about having the people who are buying it send the money to me or even directly to the charity and then getting the art to them, since the donations might be in the original artists’ possessions.
You will need to work with the charity since you will need to use their non-profit status to hold the auction. They should also be able to help you with ways to collect the donations and shipping the art. You could also ask the artist if they would be willing to take care of shipping their items to the auction winners. Once the payment has been received, then you could give the shipping information to the artists so they can do the shipping or even delivery if the winning bidder lives near by.
Good luck. One suggestion — have a local event rather than Online or combine a local event with the Online. You could have all the items on display, charge an admission fee, serve a snack/drink, and then reveal the highest bidders at the end of the event so that they can take the items home that night as soon as they have paid for them. You might make more money by charging the admission fee.

Why not just use ebay, and donate the proceeds to charity. The hardest thing about setting up any online business (whether it is profit or nonprofit) is exposure. With e bay the exposure is already there as well as all the software to run the thing. They even have connections to charities. You can have the donations made automatically by them. If the point of your endeavor is the bragging rights that you have your own website, than disregard this suggestion. If however you want a simple fast efficient, low overhead way to help others, then ebay is the way to go. Celebrities do it all the time with their charity auctions.

I am part of an organization at my workplace looking to do an Online silent auction. My experience with such auctions, so far, have been rather expensive (both for the framework and the cut the said company takes)..
